To the maximum extent permitted by applicable law, Pinger and its suppliers provide the site "as is" and with all faults, and hereby disclaim all warranties and conditions, whether express, implied or statutory, including, but not limited to, any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. You agree to indemnify, defend and hold Pinger and its officers, directors, employees, agents, licensors, and suppliers harmless from and against all claims, liabilities, losses, expenses, damages and costs, including reasonable attorneys' fees and costs of experts, resulting from any violation or breach of this Agreement by you or any activity related to access to or use of the Site by you.
This Agreement and the legal relations between the parties arising hereunder shall be governed by and interpreted in accordance with the laws of the State of California exclusively, as such laws apply to contracts between California residents performed entirely within California.
